Who Needs a DOT Number in Florida? The 26,001 Pound Line and More

Florida's statute draws its own line for intrastate trucks at 26,001 pounds, while federal rules start at 10,001 for interstate work. Here is how the two fit and what to ask.

Who needs a DOT number in Florida? It depends on weight, cargo and whether the truck ever works across state lines. Florida's statute reaches intrastate trucks through a cross-reference to the federal rules, and it carves out lighter ones: vehicles under 26,001 pounds that carry no placardable hazardous materials (Florida Statutes 316.302). Federal rules for trucks in interstate commerce start lower, at 10,001 pounds (49 CFR 390.5T). So a Florida truck can sit under one line and over the other.

How the statute is built

Section 316.302 does two things for trucks that stay in the state.

  • It adopts the federal rules. Subsection (1)(b) makes owners and drivers of commercial motor vehicles in intrastate commerce subject to 49 CFR parts 382 to 386 and 390 to 397, "as such rules and regulations existed on December 31, 2023." The marking rule, 49 CFR 390.21, sits in part 390.
  • It exempts lighter trucks. Subsection (1)(f) exempts intrastate vehicles under 26,001 pounds GVW, GVWR and GCWR that carry no placardable hazardous materials from that subsection's requirements.

The exemption lists gross weight, weight rating and combination rating together, so read all three for your setup, including any trailer.

The farm exemption asks for a different marking

Subsection (1)(e) covers an intrastate agricultural exemption. For a vehicle under it with a gross weight of 26,001 pounds or more, or three or more axles on the power unit, the statute says to display the name of the owner or motor carrier and the municipality or town where the vehicle is based. That goes on each side of the power unit, in letters that contrast with the background and can be read from 50 feet.

That list is a name and a town, not a USDOT number. A made-up citrus hauler might letter SUNRISE GROVES over OCALA. Whether the same truck also needs a USDOT number is a separate question for the state. Our builder has a city line for the second row, and the Custom USDOT Logo carries name and city together.

Florida only is not always intrastate

A truck that never leaves Florida can still be doing interstate work. The federal definition includes a trip between two places in one state as part of a movement that originates or terminates outside the state or outside the United States (49 CFR 390.5T).

Picture a box truck taking goods that arrived by ship from a seaport warehouse to a store across Florida. That is the kind of job to ask about. Whether a particular load counts is for FMCSA or the state to answer. It is the reason "Florida only" is a claim to test, not assume.

Getting and checking the number

Questions to ask the state

  1. Is my truck, with any trailer, under the 26,001 pound exemption, and do I haul nothing placardable?
  2. Do my loads ever begin or end outside Florida, even if the truck does not?
  3. For a farm truck: does the agricultural exemption apply, and does it call for a name and town?
  4. Which agency answers marking questions for my kind of truck, and is anything expected on the door beyond what this page covers?

We read the statute and FMCSA's list, not every Florida agency page, so the agency question is a real one.

Frequently asked questions

How do I apply for a DOT number in Florida?

Settle the weight and cargo questions with the state first, since Florida's rules hinge on them. If you do need a USDOT number, it comes from FMCSA's Motus system at motus.dot.gov. We did not verify a separate Florida application on top of that. FMCSA warns about look-alike sites, so type the address yourself (FMCSA).

Is there a Florida DOT number lookup?

The USDOT record is public and free to search on the SAFER Company Snapshot, by DOT number, MC or MX number or company name. Use it to confirm your number and the exact name before you order lettering. For a question about what the state itself expects, the lookup will not help, so ask the state agency.

Do pickup trucks in Florida need DOT numbers?

The statute's intrastate provision does not reach a pickup under 26,001 pounds with no placardable hazardous materials. That does not mean no number is ever needed. FMCSA lists Florida among states that require intrastate registrants to get a USDOT number, a trailer can raise the combination rating, and interstate work brings in the 10,001 pound federal line. Ask the state.

What must a Florida farm truck display?

Why does the Florida statute mention December 31, 2023?

The statute adopts the federal rules as they existed on that date. A fixed date means Florida points at that version of the federal text, not automatically at today's.
